Terms of Service
1. Acceptance
By using lowmoq.shop (the "Site") or engaging LowMOQ ("we", "us", "our") for the production of branded merchandise, you ("Customer") agree to these Terms of Service.
2. Service description
LowMOQ produces private-label custom merchandise in minimum quantities at our low minimum per style/color. Production includes premium blanks, decoration (embroidery, screen print, puff print, woven patches, heat transfer, pad print, laser engraving), and brand-system add-ons such as printed neck labels, care labels, and packaging.
3. Quotes and orders
- Quotes are valid for 14 days from issue.
- Orders are confirmed once a 50% deposit is received.
- Production begins after Customer's written approval of the digital proof.
- Balance is due before shipping.
4. Intellectual property
Customer represents and warrants that they own all rights, or have obtained all necessary licenses, to any artwork, logos, names, or other intellectual property submitted to LowMOQ for production. Customer agrees to indemnify and hold LowMOQ harmless from any claim arising from infringement of third-party intellectual property rights.
LowMOQ retains the right to display Customer's name and produced merchandise in marketing materials unless Customer requests otherwise in writing.
5. Sample policy
Samples are available at a flat fee per piece, credited against any follow-up production order placed within 60 days of sample delivery. Samples feature a generic LowMOQ test print and do not represent the Customer's final artwork.
6. Lead time and rush orders
Standard production lead time is 21 business days from artwork approval. Rush orders (under 21 days to in-hand date) carry a 20% surcharge and require explicit confirmation of vendor capacity prior to acceptance.
7. Quality and remakes
LowMOQ inspects every order at our fulfillment hub before shipping. Defects identified by Customer within 14 days of delivery are eligible for remake or credit at LowMOQ's discretion. Defects caused by Customer-approved artwork or specifications are not covered.
8. Cancellation
Orders may be cancelled with a full deposit refund prior to artwork approval. Cancellations after artwork approval and PO issuance forfeit the deposit. Cancellations after production has begun are not accepted.
9. Limitation of liability
LowMOQ's liability for any claim related to an order is limited to the amount paid by Customer for that order. We are not liable for indirect, incidental, or consequential damages.
10. Governing law
These Terms are governed by the laws of [State] and any dispute will be resolved in the courts of [County, State].
11. Changes
We may update these Terms from time to time. Material changes will be communicated to active Customers in writing.
