Terms of Service
1. Acceptance
By using lowmoq.shop (the "Site") or engaging LowMOQ ("we", "us", "our") for the production of branded merchandise, you ("Customer") agree to these Terms of Service.
2. Service description
LowMOQ produces private-label custom merchandise in minimum quantities at our low minimum per style/color. Production includes premium blanks, decoration (embroidery, screen print, puff print, woven patches, heat transfer, pad print, laser engraving), and brand-system add-ons such as printed neck labels, care labels, and packaging.
3. Quotes and orders
- Quotes are valid for 14 days from issue.
- Orders are confirmed once a 50% deposit is received.
- Production begins after Customer's written approval of the digital proof.
- Balance is due before shipping.
- Art preparation: LowMOQ reviews uploaded artwork before quoting. If a file needs rework to print well (common with images made by AI image tools, files too low in resolution for their print size, flat images such as PNG or JPG for screen printing, and flat images without a transparent background for DTF or DTG printing), LowMOQ recreates it as print-ready art for a one-time fee of $100 per design. Any such fee is listed on the quote before Customer approves it. Supplying vector artwork (AI, EPS or PDF) avoids it. Embroidery digitizing is covered by the embroidery setup fee instead.
4. Intellectual property
Customer represents and warrants that they own all rights, or have obtained all necessary licenses, to any artwork, logos, names, or other intellectual property submitted to LowMOQ for production. Customer agrees to indemnify and hold LowMOQ harmless from any claim arising from infringement of third-party intellectual property rights.
LowMOQ retains the right to display Customer's name and produced merchandise in marketing materials unless Customer requests otherwise in writing.
5. Sample policy
Samples are available at a flat fee per piece. Sample fees are a separate charge and are not credited toward full production runs. Samples are custom-made and non-refundable. Samples feature a generic LowMOQ test print and do not represent the Customer's final artwork. See the Return Policy.
6. Lead time and rush orders
Standard production is 2 weeks from artwork and mockup approval to ready-to-ship. Transit is additional and depends on the shipping method selected, ranging from approximately 5 to 30 days; the method and its transit window are confirmed on the quote. Rush production is available case by case, priced per run, and requires explicit confirmation of vendor capacity prior to acceptance.
7. Quality and remakes
LowMOQ inspects every order at our fulfillment hub before shipping. Manufacturing defects, decoration errors, or goods not matching the approved mockup, reported by Customer within 14 days of delivery, are eligible for remake or refund of the affected pieces at Customer's choice. Defects caused by Customer-approved artwork or specifications are not covered. Full terms, including how to file a claim, are in the Return Policy.
8. Cancellation
Orders may be cancelled for a full refund of amounts paid at any time before mockup approval. Once production has started, orders cannot be cancelled or refunded, because materials and labor are committed. See the Return Policy.
9. Limitation of liability
LowMOQ's liability for any claim related to an order is limited to the amount paid by Customer for that order. We are not liable for indirect, incidental, or consequential damages.
10. Governing law
These Terms are governed by the laws of the U.S. state in which LowMOQ is organized, without regard to its conflict-of-law rules, and any dispute will be resolved in the state or federal courts of that state.
11. Changes
We may update these Terms from time to time. Material changes will be communicated to active Customers in writing.
